Terms of Service

1. Services Overview

Alamond Marketing provides digital marketing services including:

  • Website design, hosting, and management
  • AI chatbot setup and operation
  • AI receptionist setup and operation
  • Google Business Profile creation and optimization
  • Ongoing support and updates

Subscription-Based Services: Website, AI chatbot, and AI receptionist services operate on a subscription model. You are licensing access to these managed services, not purchasing ownership of the underlying systems, software, or infrastructure.

One-Time Services: Google Business Profile creation and optimization is a one-time service. Once completed, the business profile belongs to the client and can be managed independently through Google.

Services may be modified, updated, or discontinued at the discretion of Alamond Marketing.

2. Acceptance of Terms

By purchasing or using Alamond Marketing services, the Client acknowledges that they have read and agree to these Terms.

Submission of payment constitutes acceptance of these Terms of Service.

3. Hosted Service Model

Most services provided by Alamond Marketing operate as hosted services

For subscription-based services (Website, AI chatbot, AI receptionist), clients are licensing access to a managed system and do not receive ownership of the underlying infrastructure, software, or systems.

Because of this:

  • Services cannot be exported
  • Websites cannot be transferred to external hosting providers
  • Services require an active subscription to remain operational

If a Client cancels service or stops payment, the website and related systems will be taken offline.

Data may be deleted immediately upon cancellation. Alamond Marketing may retain service data for up to six (6) months, after which the data may be permanently deleted and may not be recoverable.

4. Third-Party Platforms

Alamond Marketing services rely on third-party software platforms, hosting providers, and infrastructure.

If a third-party provider:

  • shuts down
  • goes out of business
  • changes policies
  • experiences outages or technical failures

then the Client's services may not be recoverable.

Alamond Marketing is not responsible for service disruptions caused by third-party platforms.

5. Client Content Responsibility

Clients are responsible for all materials submitted including:

  • images
  • text
  • marketing claims
  • business information

Alamond Marketing is not responsible for copyright violations or illegal content supplied by clients.

6. Domain Policy

Clients may use either their own existing domain name or a domain obtained through Alamond Marketing. Domains may be managed through third-party registrars and are subject to the policies of those registrars.

Domain Registration Through Alamond Marketing

Alamond Marketing offers domain registration services starting at $15 per year. Most standard domain extensions — including .com, .org, and .net — are available for $15/year. Certain premium, specialty, or country-code domain extensions may carry higher annual fees depending on registry pricing.

When a domain is purchased through Alamond Marketing, we manage the full setup process including DNS configuration and website connection, so your website is live and operational without any additional effort on your part.

Using Your Existing Domain

Clients are not required to purchase a domain through Alamond Marketing. If you already own a domain — whether registered through GoDaddy, Namecheap, Google Domains, Squarespace, or any other provider — we can connect your Alamond Marketing website directly to your existing domain at no additional cost.

To complete this connection, you may need to update your domain's DNS settings or grant temporary access to Alamond Marketing for configuration purposes. Instructions and support are provided throughout this process.

In the event a client decides to transfer their existing domain to Alamond Marketing's management, we can assist with the transfer process. Domain transfers are subject to the policies and restrictions of the originating registrar, including any applicable transfer fees or waiting periods.

7. Website Service DNS & Domain Configuration Responsibility

We are not responsible for issues arising from domain or DNS configuration changes made by the client, third party, or Alamond Marketing related to website services.

Client-Initiated Changes: If the Client modifies, updates, or independently manages domain settings—including DNS records, nameservers, or domain connections—the Client assumes full responsibility for any resulting issues, including website downtime, misrouting, or connection failures.

Incorrect DNS Settings: Incorrect DNS settings may temporarily or permanently disconnect the website from its intended hosting environment. In most cases, the Client may revert changes by restoring prior DNS records or obtaining correct configuration details from their domain provider or previous hosting provider.

Recovery Responsibility: Alamond Marketing is not obligated to restore previous configurations, reconnect domains, or resolve issues caused by Client-side or third-party DNS changes.

This clause applies specifically to website-related services and domain connections.

8. Service Initiation Fee Structure

Some services may require a Service Initiation Fee to configure and deploy the service.

When a Service Initiation Fee is required, it is paid in two parts:

  • Service Initiation Deposit — 15%
  • Service Completion Payment — 85%

Process:

Client pays the 15% Service Initiation Deposit.

Alamond Marketing develops the service.

Client reviews the completed service.

The remaining 85% must be paid before the service is delivered or activated.

If no Service Initiation Fee is required for a particular service, the client will pay the full amount once the service is complete and before delivery.

Because development begins once the deposit is paid, the deposit is generally non-refundable except under the circumstances described in the Refund Policy.

9. Support and Issue Resolution

Clients may submit support requests regarding technical issues within the provided services.

Support requests may be submitted at any time while the Client is receiving services.

Alamond Marketing will make reasonable efforts to investigate and correct issues at no additional cost.

Examples include:

  • broken buttons or links
  • loading errors
  • system glitches
  • configuration errors
  • features not functioning correctly
  • chatbot response issues
  • AI caller configuration issues

10. Refund Policy

General Policy: Alamond Marketing generally does not issue refunds. All sales are final unless the specific circumstances outlined in this Refund Policy are met.

Service Initiation Deposit: Some services may include a 15% Service Initiation Deposit, which is 15% of the total price paid upfront before delivery. This deposit is generally non-refundable except under the circumstances described below.

Final Payments: Any final payments (including the 85% balance or any other payment made after services are completed and before delivery) are generally non-refundable except under the circumstances described below.

Service Acceptance: Once the Client reviews the completed service, agrees to the service to be delivered, and pays the remaining balance or final payment, the Client acknowledges the service has been accepted, and all payments become non-refundable unless stated otherwise below. 

Non-Delivery Refund Policy:

If Alamond Marketing fails to deliver the purchased service entirely, the Client will receive a full refund of all payments made, including the 15% deposit and any remaining balance.

Misrepresentation Refund Policy:

If the service delivered is materially different from what was clearly described before purchase, the Client will receive a full refund of all payments made, including the 15% deposit and any remaining balance.

Service Failure Refund Policy:

If there are functional issues with your service, Alamond Marketing will make reasonable efforts to diagnose and resolve the issue through technical support. Only in the event of a catastrophic service failure, where the service cannot be restored or repaired due to fundamental technical issues that prevent the service from functioning as described, will you be refunded. 

If Alamond Marketing is unable to restore or repair the service to functional status within a reasonable timeframe, the Client will receive a full refund of all payments made, including the 15% deposit and any remaining balance.

Note: Design preference or appearance dissatisfaction does not qualify for a refund under this policy. The Client may instead request refinements through client resoucres page. 

12. Client Cooperation and Content Submission

Clients must provide required content and information necessary for service completion.

Failure to provide materials may delay development.

Alamond Marketing is not responsible for delays caused by missing client materials.

13. Monthly Subscription Payments

The following services operate on a subscription model:

  • Website hosting and management
  • AI chatbot
  • AI receptionist

Monthly subscription payments cover:

  • Hosting infrastructure
  • Service operation and maintenance
  • Technical support
  • Access to Client Resources portal

Billing begins once the service has been published and activated.

Note: Google Business Profile services are one-time purchases and are not subject to monthly subscriptions. Once your business profile is created or optimized, it belongs to you and does not require ongoing payments to Alamond Marketing.

14. Subscription Cancellation Policy

Clients may cancel their recurring service subscription at any time.

To request cancellation, the Client must either:

  • send a cancellation request by email to Alamond Marketing support, or
  • submit the official Subscription Cancellation Form available on the Alamond Marketing website support page.

Cancellation requests must be submitted at least 24hours before the next billing date!

If a cancellation request is submitted before the next billing date but the Client is charged for the next billing cycle while the cancellation request is being processed, Alamond Marketing will issue a refund for that charge.

Once a subscription cancellation request has been processed:

  • the Client's services will be discontinued
  • the website and related systems may be taken offline
  • AI chatbot and AI caller services may be deactivated
  • access to hosted systems may be removed

Data may be deleted immediately upon cancellation. Alamond Marketing may retain service data for up to six (6) months after cancellation, but service data may be permanently deleted at any time and may not be recoverable.

Stopping payment or canceling payment through a bank or payment processor does not constitute a valid cancellation request.

Clients must follow the cancellation procedures described above for a cancellation to be recognized.

15. Client Resources and Revision Policy

Clients have access to the Client Resources portal, which provides forms for managing their subscription services.

Website Revision Form:

Clients may submit one Website Revision Form per calendar month. This form allows clients to request changes to their website including:

  • New pictures or image updates
  • New services offered
  • Updates to basic information on the website

These website revisions are provided at no additional cost. Unused revisions do not roll over to future months.

AI Chatbot & AI Caller Revision Forms:

Clients may submit one AI Chatbot Revision Form and one AI Caller Revision Form per calendar month. These forms allow clients to request updates including:

  • Response updates and adjustments
  • Conversation flow modifications
  • FAQ updates and changes
  • Greeting and prompt updates
  • Business information synchronization
  • New scenarios or use cases

These AI revisions are provided at no additional cost. Unused revisions do not roll over to future months.

General Information Revision Form:

Clients may submit the General Information Revision Form anytime they need updates applied across all platforms managed by Alamond Marketing. This may include:

  • New hours or holiday hours
  • New location
  • New phone number or email
  • Any other general information updates

These general information updates are provided at no additional cost and can be submitted anytime they are needed.

Additional Services:

AI Chatbot and AI Caller updates may include response updates, conversation flow adjustments, FAQ updates, greeting changes, and business information updates. These are covered under your active subscription.

Additional revision requests beyond what is covered may incur additional service fees.

16. Telecommunication Compliance

Clients are responsible for ensuring their use of AI calling systems complies with applicable telecommunications laws.

17. Marketing Results Disclaimer

Alamond Marketing provides marketing tools, infrastructure, and automation services; however, Alamond Marketing does not guarantee any specific business results.

This includes but is not limited to:

  • increased sales
  • increased leads
  • increased website traffic
  • business growth or profitability

Actual results depend on many external factors beyond Alamond Marketing's control.

18. Data Loss Disclaimer

Alamond Marketing cannot guarantee protection from data loss resulting from system failures, cyber incidents, third-party outages, software issues, or other unforeseen technical events.

Clients are responsible for maintaining backups of any important data or content they wish to preserve.

19. Limitation of Liability

To the fullest extent permitted by law, Alamond Marketing shall not be liable for indirect, incidental, consequential, or special damages including:

  • lost profits
  • loss of business opportunities
  • loss of data
  • service interruptions
  • financial losses resulting from service use

20. Indemnification

Clients agree to indemnify, defend, and hold harmless Alamond Marketing from any claims, damages, liabilities, losses, or expenses arising from:

  • client-provided content
  • the client's business practices
  • misuse of Alamond Marketing services
  • violation of applicable laws or regulations

21. Force Majeure

Alamond Marketing shall not be responsible for delays or failure to perform services due to circumstances beyond reasonable control including:

  • natural disasters
  • internet outages
  • cyberattacks
  • government actions
  • infrastructure failures
  • third-party service disruptions

22. Chargeback Policy

Clients agree not to initiate chargebacks or payment disputes after services have been delivered or activated.

If a chargeback occurs, Alamond Marketing reserves the right to suspend or terminate services and pursue recovery of unpaid balances.

23. Governing Law

These Terms of Service shall be governed and interpreted in accordance with the laws of the State of California.

24. Contact

Questions regarding these Terms of Service may be directed to Alamond Marketing support through the official contact methods provided on the Alamond Marketing website.

25. Modifications

Alamond Marketing reserves the right to update or modify these Terms at any time.

Continued use of services after modifications constitutes acceptance of the updated Terms.

26. Service Availability Disclaimer

Services may occasionally experience downtime due to maintenance or technical issues.

Alamond Marketing does not guarantee uninterrupted service availability.

27. Business Loss Disclaimer

Alamond Marketing shall not be responsible for financial losses resulting from use of its services.

28. Entire Agreement

These Terms of Service constitute the entire agreement between the Client and Alamond Marketing regarding the services provided.

These Terms supersede any prior agreements, communications, or understandings related to the services.
