Terms of Service

1. Services

Alamond Marketing provides digital services including but not limited to:

  • website design and hosting
  • AI chatbot setup and operation
  • AI caller setup and operation
  • automation tools and integrations
  • ongoing support and updates

Services may be modified, updated, or discontinued at the discretion of Alamond Marketing.

2. Acceptance of Terms

By purchasing or using Alamond Marketing services, the Client acknowledges that they have read and agree to these Terms.

Submission of payment constitutes acceptance of these Terms of Service.

3. Hosted Service Model

All services provided by Alamond Marketing operate as hosted services.

Clients are purchasing access to a managed system and do not receive ownership of the underlying infrastructure, software, or systems.

Because of this:

  • services cannot be exported
  • websites cannot be transferred to external hosting providers
  • services require an active subscription to remain operational

If a Client cancels service or stops payment, the website and related systems will be taken offline.

Alamond Marketing may retain service data for up to six (6) months, after which the data may be permanently deleted.

4. Third-Party Platforms

Alamond Marketing services rely on third-party software platforms, hosting providers, and infrastructure.

If a third-party provider:

  • shuts down
  • goes out of business
  • changes policies
  • experiences outages or technical failures

then the Client's services may not be recoverable.

Alamond Marketing is not responsible for service disruptions caused by third-party platforms.

5. Intellectual Property

All systems, automation workflows, integrations, AI scripts, and service frameworks created by Alamond Marketing remain the exclusive intellectual property of Alamond Marketing.

Clients receive a limited license to use the services while their subscription remains active.

Clients may not:

  • copy service systems
  • reverse engineer services
  • replicate automation frameworks

6. Client Content Responsibility

Clients are responsible for all materials submitted including:

  • images
  • text
  • marketing claims
  • business information

Alamond Marketing is not responsible for copyright violations or illegal content supplied by clients.

7. Domain Policy

Clients may either:

  • use their own domain name
  • use a domain obtained through Alamond Marketing

Domains may be managed through third-party registrars.

8. DNS & Domain Configuration Responsibility

Alamond Marketing is not responsible for any issues arising from domain or DNS configuration changes made by the Client or any third party.

If the Client chooses to modify, update, or manage their domain settings independently, including but not limited to DNS records, nameservers, or domain connections, the Client assumes full responsibility for any resulting issues, including website downtime, misrouting, or connection failures.

Alamond Marketing is not liable for restoring previous configurations, reconnecting domains, or resolving issues caused by Client-side changes.

The Client acknowledges that incorrect DNS settings may temporarily or permanently disconnect the website from its intended hosting environment. In most cases, the Client may revert changes by restoring prior DNS records or obtaining correct configuration details from their domain provider or previous hosting provider.

This clause applies specifically to website-related services and domain connections.

9. Service Initiation Fee Structure

Each service requires a Service Initiation Fee to configure and deploy the service.

The Service Initiation Fee is paid in two parts:

  • Service Initiation Deposit — 15%
  • Service Completion Payment — 85%

Process:

Client pays the 15% Service Initiation Deposit.

Alamond Marketing develops the service.

Client reviews the completed service.

The remaining 85% must be paid before the service is delivered or activated.

Services will not be delivered until the remaining balance has been paid in full.

10. Service Initiation Deposit Policy

The Service Initiation Deposit (15%) is required before Alamond Marketing begins development of any purchased service.

This deposit covers project onboarding, preparation, configuration, and development scheduling.

Because development begins once the deposit is paid, the deposit is generally non-refundable.

The deposit may only be refunded under the circumstances described in Section 10.

11. Service Non-Delivery or Misrepresentation Refund Policy

If Alamond Marketing fails to deliver the purchased service entirely, the Client may request a refund of the 15% Service Initiation Deposit.

Additionally, the deposit may be refunded if the service delivered is materially different from what was clearly described before purchase.

However, once the Client:

  • reviews the completed service
  • agrees for the service to be delivered
  • pays the 85% Service Completion Payment

the Client acknowledges the service has been accepted.

After approval and payment of the 85% completion payment, the 15% Service Initiation Deposit becomes permanently non-refundable under any circumstances.

12. 24-Hour Satisfaction Policy

Service Delivery occurs when the completed service is presented to the Client or when service access credentials are provided.

Clients may request cancellation and a refund within 24 hours of Service Delivery for any reason.

Refunds apply only to the 85% Service Completion Payment.

The 15% deposit remains non-refundable.

If a refund is approved:

  • the service will be cancelled
  • the website or related systems will be taken offline
  • access will be removed
  • the refund will be processed

13. 7-Day Functional Issue Policy

Clients may request a refund within 7 days of Service Delivery if valid functional issues occur.

Examples include:

  • broken website buttons
  • system glitches
  • pages not loading correctly
  • critical functionality failures

Design preference or appearance dissatisfaction does not qualify.

Refunds apply only to the 85% completion payment.

The 15% deposit remains non-refundable, even if technical issues occur.

If the Client prefers to keep the service, Alamond Marketing may instead fix the issue through support under Section 13.

14. Alamond Marketing Support and Issue Resolution Policy

Clients may submit support requests regarding technical issues within the provided services.

Support requests may be submitted at any time while the Client is receiving services.

Alamond Marketing will make reasonable efforts to investigate and correct issues at no additional cost.

Examples include:

  • broken buttons or links
  • loading errors
  • system glitches
  • configuration errors
  • features not functioning correctly
  • chatbot response issues
  • AI caller configuration issues

15. Client Cooperation and Content Submission

Clients must provide required content and information necessary for service completion.

Failure to provide materials may delay development.

Alamond Marketing is not responsible for delays caused by missing client materials.

16. Monthly Subscription Payments

Certain services require a monthly subscription.

Monthly payments cover:

  • hosting infrastructure
  • service operation
  • maintenance
  • support

Billing begins once the service has been published and activated.

17. Subscription Cancellation Policy

Clients may cancel their recurring service subscription at any time.

To request cancellation, the Client must either:

  • send a cancellation request by email to Alamond Marketing support, or
  • submit the official Subscription Cancellation Form available on the Alamond Marketing website support page.

Cancellation requests must be submitted before the next billing date to prevent the next billing cycle from occurring.

If a cancellation request is submitted before the next billing date but the Client is charged for the next billing cycle while the cancellation request is being processed, Alamond Marketing will issue a refund for that charge.

Once a subscription cancellation request has been processed:

  • the Client's services will be discontinued
  • the website and related systems may be taken offline
  • AI chatbot and AI caller services may be deactivated
  • access to hosted systems may be removed

Alamond Marketing may retain service data for up to six (6) months after cancellation. After this period, service data may be permanently deleted and may not be recoverable.

Stopping payment or canceling payment through a bank or payment processor does not constitute a valid cancellation request.

Clients must follow the cancellation procedures described above for a cancellation to be recognized.

18. Support and Revision Policy

Clients may submit one Service Revision Request Form per calendar month.

Each revision request may include updates across the following services:

Website

Up to 10 minor website changes, including:

  • text edits
  • image updates
  • color adjustments
  • layout adjustments

AI Chatbot

Updates may include:

  • response updates
  • conversation flow adjustments
  • FAQ updates

AI Caller

Updates may include:

  • greeting changes
  • call flow adjustments
  • business information updates

Unused revisions do not roll over to future months.

Additional requests may incur additional service fees.

19. Telecommunication Compliance

Clients are responsible for ensuring their use of AI calling systems complies with applicable telecommunications laws.

20. Marketing Results Disclaimer

Alamond Marketing provides marketing tools, infrastructure, and automation services; however, Alamond Marketing does not guarantee any specific business results.

This includes but is not limited to:

  • increased sales
  • increased leads
  • increased website traffic
  • business growth or profitability

Actual results depend on many external factors beyond Alamond Marketing's control.

21. Data Loss Disclaimer

Alamond Marketing cannot guarantee protection from data loss resulting from system failures, cyber incidents, third-party outages, software issues, or other unforeseen technical events.

Clients are responsible for maintaining backups of any important data or content they wish to preserve.

22. Limitation of Liability

To the fullest extent permitted by law, Alamond Marketing shall not be liable for indirect, incidental, consequential, or special damages including:

  • lost profits
  • loss of business opportunities
  • loss of data
  • service interruptions
  • financial losses resulting from service use

23. Indemnification

Clients agree to indemnify, defend, and hold harmless Alamond Marketing from any claims, damages, liabilities, losses, or expenses arising from:

  • client-provided content
  • the client's business practices
  • misuse of Alamond Marketing services
  • violation of applicable laws or regulations

24. Force Majeure

Alamond Marketing shall not be responsible for delays or failure to perform services due to circumstances beyond reasonable control including:

  • natural disasters
  • internet outages
  • cyberattacks
  • government actions
  • infrastructure failures
  • third-party service disruptions

25. Chargeback Policy

Clients agree not to initiate chargebacks or payment disputes after services have been delivered or activated.

If a chargeback occurs, Alamond Marketing reserves the right to suspend or terminate services and pursue recovery of unpaid balances.

26. Governing Law

These Terms of Service shall be governed and interpreted in accordance with the laws of the State of California.

27. Contact

Questions regarding these Terms of Service may be directed to Alamond Marketing support through the official contact methods provided on the Alamond Marketing website.

28. Modifications

Alamond Marketing reserves the right to update or modify these Terms at any time.

Continued use of services after modifications constitutes acceptance of the updated Terms.

29. Service Availability Disclaimer

Services may occasionally experience downtime due to maintenance or technical issues.

Alamond Marketing does not guarantee uninterrupted service availability.

30. Business Loss Disclaimer

Alamond Marketing shall not be responsible for financial losses resulting from use of its services.

31. Account Termination

Alamond Marketing may suspend or terminate services if a Client violates these Terms or engages in illegal or abusive activity.

31. Entire Agreement

These Terms of Service constitute the entire agreement between the Client and Alamond Marketing regarding the services provided.

These Terms supersede any prior agreements, communications, or understandings related to the services.
